Additional Fees

In addition to these probate fees, you will also need to pay $200 plus taxes to the court for a file administration fee. This fee is paid when you submit your documents to the Probate Registry for review.

Cautions

Please note that you should NOT include the value of any assets which are owned as a true joint tenant with another person, or which have a designated beneficiary named on them when calculating the value of the estate.

Additionally, it may be possible for you to deduct the value of a mortgage from any value for real property.

Probate fees are set by law in the Probate Fee Act and can change from time to time.

When the fees are due

Probate fees are due and payable once the Probate Registry has reviewed and approved your application for a Grant. The Registry will not release your Grant until you have paid the probate fees.

Once you submit your documents for review and approval by the Court, you should start the process to sort out where you will get these fees from.

Where to get the fees from

You might be able to get these fees from the deceased's bank, or you might have to pay them out of your own funds. If you pay them from your own funds, make sure to keep good records so you can be properly reimbursed.

You will need to pay these fees by way of a draft payable to the Minister of Finance.
