If you have been asked to help someone as an Attorney under a Power of Attorney, a Representative under a Representation Agreement, and you’re not sure what to do, we can help. If you need to make a Committeeship application for someone, we can help.

Committeeships

committee (pronounced “kaw-mit-tea”) is a person who has been granted a court order requiring them to look after an incapable person.

Committeeship is the process of legally managing the person or the financial affairs of an incapable person. In this context, the incapable person is called a patient.

If you have a friend or family member who is incapable and who didn’t appoint anyone to help them under a Power of Attorney or Representation Agreement, you, or someone else in the patient’s family or circle of friends can apply to court to be appointed as their committee.

If the patient has no friends or family able to be their committee, the Public Guardian and Trustee might seek to be appointed as their committee.

If you have been appointed as an Attorney under a Power of Attorney, and aren’t sure how to proceed, we can give you some guidance on your work.

If you have not yet accepted your appointment under the Power of Attorney, call us for an appointment, and we will meet with you to explain your role, and take your signatures on the document so you can start to use it.

Support for Representatives

If you have been appointed as a Representative under a Representation Agreement, we can give you some guidance on your work.

You do not usually need to sign a Representation Agreement in front of a BC Notary or lawyer. If you have questions on the type of work you need to do for your person, call us; we will review the Representation Agreement with you, and explain your role.
